Frequently asked Questions and answers.

Here we provide answers to frequently asked questions about accidents.

What counts as an accident?

An accident is defined as a sudden, unintentional, damaging effect on the human body of an unusual external factor, which results in an impairment of health or death.

Whether an event is classified as an accident or illness may be disputed on a case-by-case basis; we will check this for you and represent your interests vis-à-vis your accident insurance company.

As an employee, do I have compulsory accident insurance?

In principle, employees are compulsorily insured against occupational accidents through their employer. After a certain minimum working time, there is also insurance coverage against non-occupational accidents.

The employer pays the premiums for occupational accident insurance; the costs of non-occupational accident insurance can be transferred in whole or in part to employees.

What is the difference between an occupational accident and a non-occupational accident?

Occupational accidents are accidents which occur to an insured person during work carried out by order of or in the interest of the employer. This also includes accidents during breaks at work and before or after work, provided that the insured person is authorised to stay at the company.

Non-occupational accidents include all other accidents, in particular leisure accidents.

We would be happy to check individually for you what type of accident has occurred and whether there is insurance coverage.

What is an occupational disease and how does it differ from an illness?

For an illness to be considered an occupational disease, certain conditions must be met. For example, it must have been caused exclusively or primarily by harmful substances, certain types of work or professional activities.

In contrast to ordinary illnesses, occupational diseases are covered by accident insurance and not by compulsory health insurance. In this way, the liability of accident insurance is clearly differentiated from that of health insurance.

What happens if the accident is due to gross negligence?

In the event of gross negligence, accident insurance has the option to reduce certain benefits or claim recourse.

The legal situation in such cases is complex, in particular when it comes to the delimitation of claims and liability; we support you in preventing unjustified cuts.
