Frequently asked Questions and answers.
Typical questions in road traffic law may include:
A penalty order means that the public prosecutor wants to convict you of a traffic offense. If an appeal is not filed in writing with the competent public prosecutor's office within 10 days, the penalty order will be treated as a final verdict. The specified legal consequences then also occur.
We would be happy to assist you with an appeal.
An appeal against a penalty order must be lodged within 10 days.
Otherwise, there are further deadlines which can be set by authorities, e.g. for a statement. It is important that such deadlines are also met on time.
If time limits are set, this must be stated in the correspondence by the competent authority.
Whether the driver's license must be handed in and for how long is regulated by the road traffic authority and depends on the classification of the infringement and the previous records.
We would be happy to check for you whether the withdrawal of your driver's license is legal.
If the permit has not already been withdrawn directly, the date of submission is generally determined by the decision of the road traffic authority.
Under certain conditions, the submission date can be selected or postponed.
We would be happy to advise you on any concerns you may have and how to submit such an application.
A driving fitness test is ordered in particular in the event of serious offenses, speeding offenses, repeated gross violations, alcohol/drugs or doubts about personal or health fitness. A driving aptitude test is also carried out if the practical test has not been passed three times.
If the clarification is positive, the driver's license can be recovered (often subject to conditions); in the event of a negative result or refusal, the permit can be withdrawn for a longer period of time or indefinitely until a new clarification shows a positive result.
In the event of a massive violation, the authority generally classifies the infringement as gross or as a frenzied offense. In the event of a gross infringement, there is a risk of imprisonment of up to three years or a fine and at least three months of withdrawal of the driver's license the first time. Frenzy offenses usually result in imprisonment of between one and four years as well as lengthy driver's license withdrawals.
